Terms & Conditions

These Terms & Conditions govern access to and use of Traidly, including its website, accounts, tradie profiles, messaging, jobs, subcontracting features, Trade Market, saved items, alerts, Traidly Pro subscriptions and related services (the “Platform”). By creating an account, purchasing a subscription or using the Platform, you agree to these Terms.

If you use Traidly on behalf of a business or other organisation, you confirm that you are authorised to act for it. If you do not agree to these Terms, you must not use the Platform.

Traidly provides technology that enables customers, tradies, businesses, subcontractors, workers, buyers and sellers to advertise, discover, communicate and connect with each other. Traidly is a platform provider and, unless expressly stated otherwise, is not the employer, employee, contractor, subcontractor, principal, agent, broker, insurer, licensing authority, seller, buyer or representative of any user.

Traidly is not a party to contracts or arrangements made between users for trade services, employment, subcontracting, labour, marketplace goods or other user-to-user transactions. Users deal with each other independently and are responsible for negotiating and documenting their own scope, price, payment, timing, warranties, safety requirements and other contractual terms.

Traidly must not be relied on as a substitute for your own enquiries. Before engaging, employing, contracting with, buying from, selling to or otherwise dealing with another user, you are responsible for carrying out checks appropriate to the proposed arrangement.

Depending on the circumstances, checks may include identity, ABN or business details, licences, registrations, permits, qualifications, tickets, work rights, insurance, workers compensation arrangements, references, experience, reputation, ownership of goods, safety systems, pricing, payment details and suitability for the relevant work or transaction.

A profile, listing, review, featured placement, alert, search result, Traidly Pro status or other presence on the Platform does not mean Traidly has independently verified or endorsed that user or information. Where Traidly later introduces a specifically identified verification feature, only the checks expressly described for that feature should be treated as having been performed by Traidly.

You must provide information that is accurate and not misleading and keep your account details reasonably current. You are responsible for keeping your credentials secure and for activity carried out through your account, except to the extent the law makes Traidly responsible.

You must not impersonate another person or business, create deceptive accounts, misuse another person’s information, evade a suspension or restriction, share access in a way that compromises security, or use Traidly for an unlawful purpose.

You are responsible for content you submit, including business details, profile information, photos, reviews, job posts, subcontracting posts, marketplace listings and messages. You must have the rights and permissions needed to submit that content.

Content must not be false or misleading, fraudulent, defamatory, threatening, discriminatory, unlawful, infringe intellectual property or privacy rights, contain malicious code, or otherwise breach these Terms or applicable law.

You retain ownership of content you own. You grant Traidly a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and technically process that content as reasonably necessary to operate, secure, promote and improve the Platform. This licence ends when the content is deleted, except where copies are reasonably retained in backups, security records, legal records or dispute material.

Trade and occupational requirements differ between industries and Australian states and territories. Traidly does not guarantee that a user holds every licence, registration, qualification, permit, ticket or insurance required for particular work.

The person seeking or providing work must independently determine what legal and regulatory requirements apply and verify compliance with the relevant regulator, insurer or other authoritative source before work begins.

Traidly Pro, a profile badge, review, featured placement or high search position is not a certification or guarantee of workmanship, licensing, insurance, financial standing, safety, availability or suitability.

Terms such as “subbie”, “subcontractor”, “contractor”, “job” or “work” used on Traidly are descriptive platform labels only and do not determine a person’s legal employment status. The true legal relationship depends on the actual arrangement and applicable law.

Users are responsible for determining and complying with applicable employment, award, minimum pay, superannuation, tax, workers compensation, workplace health and safety, insurance, licensing, right-to-work and independent contracting obligations. Traidly must not be used to facilitate sham contracting, unlawful job advertisements or avoidance of workplace entitlements.

Jobs and subcontracting opportunities are supplied by users. Traidly does not guarantee that an opportunity is genuine, remains available, proceeds, produces any amount of work, receives responses or results in payment.

Users should keep important agreements in writing, confirm who they are contracting with, verify changed bank or payment instructions independently, and obtain professional advice where appropriate.

Trade Market allows users to advertise goods. Unless Traidly expressly states otherwise for a particular transaction, Traidly does not own listed goods, act as seller or buyer, take possession, inspect condition, authenticate goods, arrange delivery, provide escrow or guarantee payment.

Sellers must have the right to sell what they list and accurately describe the item, price and condition. Users must not list stolen, counterfeit, unlawful, dangerous or prohibited goods or anything that breaches applicable law or Traidly’s rules.

Australian Consumer Law rights may apply to user-to-user transactions, particularly where a seller acts in trade or commerce. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded.

Messaging is provided to help users communicate. Traidly does not guarantee the identity, intentions, statements or conduct of another user and does not become a party to an arrangement merely because users communicate through the Platform.

Do not send passwords or authentication codes to other users. Exercise caution with deposits, unusual payment requests, links, requests to move conversations off-platform and changes to bank details.

Reviews and feedback must reflect genuine experiences and must not be fabricated, purchased, manipulated, retaliatory, defamatory or used to harass another person. Traidly may moderate, restrict or remove reviews that reasonably appear to breach these Terms, platform rules or applicable law.

Traidly Pro is an optional paid subscription. The current price, billing interval and material features are displayed before purchase and form part of your subscription agreement. Unless the checkout states otherwise, Traidly Pro renews automatically for successive billing periods until cancelled.

By subscribing, you authorise Traidly’s payment provider to charge the applicable subscription amount using your selected payment method at each renewal. Taxes or other charges will be disclosed where required.

You can cancel through the subscription-management functionality made available by Traidly. Unless otherwise stated at purchase or required by law, cancellation stops future renewals and Pro access continues until the end of the already-paid billing period. Deleting an account or ceasing to use Traidly does not necessarily cancel a subscription; use the provided subscription cancellation process.

If a payment fails, Traidly may retry the payment, ask you to update your payment method, restrict paid features or allow the subscription to lapse. Traidly Pro does not guarantee leads, jobs, revenue, profile views, responses, ranking, business success or any particular commercial result.

Traidly may change future subscription pricing or paid features. Where a change materially disadvantages an existing subscriber, Traidly will provide reasonable notice where required and will not rely on these Terms to remove non-excludable consumer rights. Price changes will apply in the manner disclosed to the subscriber and subject to applicable law.

Refunds are not provided merely because a subscriber changes their mind, except where Traidly expressly offers one or the law requires one. Nothing in these Terms limits any refund, replacement, cancellation or other remedy available under the Australian Consumer Law or another law that cannot be excluded.

Alerts, recommendations, search results, featured content and notifications are convenience features. They may be delayed, incomplete, unavailable or based on information supplied by users. You remain responsible for verifying information and must not rely on an alert or ranking as professional advice, verification or a guarantee of suitability.

You must not use Traidly to scam, deceive, threaten, exploit or harm others; send unlawful spam; scrape or harvest data without permission; interfere with security; distribute malware; manipulate reviews or platform metrics; unlawfully discriminate; facilitate illegal transactions; or attempt to gain unauthorised access to accounts, data or systems.

Traidly may cooperate with regulators, law enforcement or other authorities where required or authorised by law.

Traidly may investigate suspected misuse and may restrict, suspend or terminate access, remove or limit content, disable features or take other reasonable protective action where we reasonably believe it is necessary to enforce these Terms, protect users or the Platform, prevent fraud or security risks, or comply with law.

Where appropriate and lawful, Traidly may provide notice or an opportunity to respond. Serious, repeated, fraudulent, unsafe or unlawful conduct may result in immediate action.

Users are primarily responsible for resolving disputes arising from their own contracts, work, goods, payments, conduct or communications. Traidly may choose to assist with information or platform moderation but is not required to adjudicate private disputes and does not become liable for the underlying transaction by assisting.

You should preserve relevant messages, agreements, invoices, receipts and other records and seek independent legal, regulatory, insurance or professional assistance where appropriate.

Traidly’s name, branding, software, interface, original graphics and other Platform materials are owned by or licensed to Traidly and protected by applicable intellectual property laws. Except as permitted by law or these Terms, you must not copy, reverse engineer, reproduce or commercially exploit Traidly intellectual property without permission.

Traidly aims to provide a reliable and secure Platform but does not promise uninterrupted, error-free or permanently available access. Maintenance, outages, security events and third-party service failures may affect availability. Features may evolve as the Platform develops.

To the maximum extent permitted by law, Traidly is not responsible for independent third-party websites, services, payment providers or user conduct merely because they are linked to or used with the Platform.

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, including applicable rights under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

Subject to those non-excludable rights and to the maximum extent permitted by law, Traidly is not responsible for loss arising from the acts or omissions of users or from user-to-user contracts, representations, workmanship, employment or contracting arrangements, goods, payments, injuries, property damage or disputes where Traidly is not the supplier or responsible party.

To the extent permitted by law, you are responsible for loss, claims or costs caused by your unlawful conduct, your breach of these Terms, content you submit, or your infringement of another person’s rights. This provision does not require you to indemnify Traidly for loss caused by Traidly’s own negligence, breach of law or other conduct for which liability cannot lawfully be excluded.

Traidly’s Privacy Policy explains how personal information is handled. By using features such as messaging, alerts and subscriptions, you may receive operational communications necessary to provide those features.

Commercial electronic messages will be handled in accordance with applicable Australian spam laws. Where an unsubscribe facility is required, users can use it to opt out of marketing communications without preventing necessary account, security, transaction or service messages.

Traidly may update these Terms to reflect changes to the Platform, law, security or operations. Where a change materially affects existing users’ rights or obligations, Traidly will take reasonable steps to provide notice where appropriate and required. The current version will be published with its effective date.

These Terms are governed by the laws applicable in Queensland, Australia. The parties submit to courts and tribunals having jurisdiction there, subject to any non-excludable right to bring a claim elsewhere.
